RESUMO

This Accord publishes in the Registro Oficial the text of the Andean Instrument on Labour Migration, adopted by the National Congress of Ecuador on 24 June 1987. Under the Instrument, member countries are not to impede the entry and departure of migrant workers who have been contracted in conformity with the Instrument and the immigration laws of the country of immigration. Migrant workers are not to be discriminated against on the basis of race, sex, religion, or nationality and are to have, in general, the same rights of workers of the country of immigration. Workers and their families are also to have the same rights as nationals to education, housing, health care, and social security. Further provisions of the Instrument set forth specific rules with respect to temporary workers, border workers, and undocumented workers.

RESUMO

This Decree, which is aimed at guaranteeing health care for all the people of Costa Rica, recognizes the right of persons insured by the State to receive, without direct payment, services to protect their health in the facilities of the Costa Rica Social Security Fund. A person insured by the State is defined as a user of health services not included in any of the schemes, categories, or agreements of the Fund and who cannot pay for health services. Further provisions of the Decree set forth rules on determining who is eligible to receive health services and the financing of such services, among other things.

PIP: This document contains provisions of the 1988 Regulations of Cuba's Public Health Law relating to primary health care, maternal-child health care, sex education, contraceptives, and health care of the elderly. The regulations guarantee maternal-child care in a program which will be revised and updated periodically. All pregnant women will receive medical assistance, and pregnant women at risk will receive specialized care. Institutionalized deliveries are also guaranteed. Attention will be paid to early diagnosis and proper treatment of uterine and breast cancer and to reproductive health care. Children will receive preventive and curative medical assistance. Health education activities will be directed toward the prevention of adolescent pregnancy. Assistance to the elderly will take the form of rehabilitation services, hospital care, housing, domiciliary assistance, and social organizations.^ieng

RESUMO

This Decree amends Section 44 of the Constitution of Uruguay to read as follows: "44. The State shall legislate on all matters related to public health and hygiene, and shall assure the improvement of the physical, moral, and social well-being of all the inhabitants of the country. All inhabitants shall have a duty to care for their own health and to have themselves treated in the event of disease. The State shall make available, without charge, means of prevention and medical care to indigent persons or to persons lacking sufficient resources."

This Decree regulates the relationships between the Ministry of Public Education and the Ministry of Health of Costa Rica with respect to services provided in Centers of Education and Nutrition and Comprehensive Care Centers for Children. Under Section 4, the Ministry of Public Education is responsible for defining educational policy and the syllabi and curricula provided in these Centers; subjects specified by the Ministry of Health, within the framework of its jurisdiction, including education for health, are to be incorporated. Section 6 defines the functions and duties of the directors of these Centers; they are responsible for, in particular, participating in determining the skills and capacities of children admitted to establishments, with a view to accommodating them according to the care they need. They are likewise responsible for monitoring this diagnosis, and for identifying and referring to a physician on the staff of a health center children liable to be suffering from physical or mental disorders.

PIP: This document contains major provisions of a 1988 Resolution of Argentina approving the Reproductive Health Program (RHP) in the Ministry of Social Works. The objective of the RHP is to provide adequate assistance to the population most in need of reproductive health planning. The target population is defined as women who are infertile, have given birth (coverage to last two years), who have had an abortion, who are under 18 or over 40, who have given birth four or more times, who have had two or more Cesarean sections, whose last pregnancy resulted in fetal mortality, or who have a disease which contraindicates pregnancy (including genetic risk or mental disturbance). The RHP will provide education and medical assistance to identified women. These activities will necessitate formation of a team of human resource personnel. The goal of the first year of the program is to locate and follow-up 70% of the women who gave birth or had an abortion during that year. Reaching this goal will necessitate the design of educational activities, the creation of a team to carry out the task, the creation of a registry and regulations, the establishment of a control and monitoring system, and the performance of an evaluation.^ieng

The Commission of Costa Rica referred to in the title was established by Decree No. 17273-S of 31 October 1986 (Annual Review of Population Law, Vol. 13, 1986, Section 920). Section 3 of the present Decree lays down that the primary objective of the Commission is to promote breast feeding by means of activities in the fields of care, education, law, research, and information dissemination. Section 5 lays down that, in order to carry out its functions, the Commission may have recourse to the technical assistance and financial support of the Institute of Nutrition for Central America and Panama (INCAP), the Pan American Health Organization, the UN Children's Fund, and the agencies that form part of the Commission, depending on their respective financial resources. Section 6 lays down that the Commission is to function as a coordinating agency between public and private establishments undertaking activities to promote breast feeding and to organize groups carrying out activities related to breast feeding. Under Section 7, the Commission's functions are as follows: ensuring that the information disseminated by the various media on breast milk and breast-milk substitutes is not prejudicial to breast feeding; ensuring the satisfactory implementation of and compliance with the rules issued to foster breast feeding in health care centers in the country; encouraging the inclusion of matters relating to breast feeding and its promotion in the different levels of official education; encouraging the training of personnel who, on account of their functions, undertake activities in the maternal and child care field; contributing to the development of educational materials relating to breast feeding; ensuring awareness of legislation directly or indirectly fostering breast feeding and implementing such legislation; encouraging research enabling priorities to be established in decision-making for improving maternal and child health; and performing all other duties laid down by the law or deemed necessary by the Commission to achieve its objectives. Under Section 11, the Commission is to maintain contacts with corresponding commissions in countries in Central America, the Caribbean, and elsewhere as well as with international organizations and agencies undertaking activities in the field of maternal and child care.

This Decree sets forth the Health Code of El Salvador. Among other things, it describes health activities with respect to maternal-child health. It provides that it is the "ineluctable obligation of the State to promote, protect, and restore the health of the mother and child by all means at its disposal." To this end, health organizations are "to give preventative and curative attention to the mother during pregnancy and delivery and after birth and the same to children from conception to the end of schooling." The State is also to promote the creation, maintenance, and development of organizations whose goal is the protection of the mother and child. The Decree lists, among health infractions, the failure to have a blood test for syphilis performed on every pregnant woman. The Decree also provides that the Ministry of Health, in conformity with its resources and regulations, is to give assistance to the elderly and to indigent disabled persons.

Title XI of these Mexican Regulations contains provisions on food for infants and young children. Among other things, these provisions require that the Secretariat of Health establish appropriate measures for the promotion of breast feeding, require medical units in the health care sector to refrain from promoting the use of breast-milk substitutes, and prohibit the employment in such units of representatives of professional departments, maternity nurses, or similar staff paid by manufacturers of infant formulas.

This Decree sets forth the organization and functioning of Mexico's National Institute of Perinatology. The objectives of the Institute are the following: 1) to support the functioning and consolidation of the National Health System and to contribute to the fulfillment of the right to health protection with respect to perinatal care; 2) to support the execution of sectoral health programs within the scope of the System's functions and services; 3) to provide health services to women experiencing high risk pregnancies, in particular, services related to preventive and curative medicine and surgical procedures; 4) to provide medical consultation and hospital assistance, as well as services for human reproduction, growth, and development, in the installations created for this purpose; these services will either be free of charge or the charge will be based on the social and economic conditions of the users; 5) to provide measures of social assistance for those patients who lack economic resources; 6) to conduct studies and clinical research in the biomedical field and related sciences for the prevention, diagnosis, and treatment of perinatal diseases and in compliance with the provisions of the General Health Law and applicable regulations; 7) to provide technical and scientific information on health findings and improvements as well as to publish the outcome of studies and work undertaken; 8) to promote and hold meetings and carry out scientific national or international exchange programs with similar institutions; 9) to advise and deliver opinions to the Health Secretary when requested; 10) to function as an advisory committee for the relevant institutions of the Federal Public Administration and social and private institutions in this field; 11) to exploit specialized human resources for attention to perinatal problems in compliance with the applicable regulations; 12) to organize and implement educational and professional programs in the field of perinatal care for the professional, technical, and auxiliary staff; 13) to confer academic awards and give recognition to studies in compliance with applicable regulations; 14) to promote the execution of health protection activities according to the applicable regulations; 15) to provide all other services and necessary activities to fulfill the goals of this Decree and other applicable regulations. Further provisions of the Decree deal with the duties of the Governing Board and the Director General, among other things.

This Act declares the protection of and attention to the health of children to be a national priority and the implementation of programs to benefit Peruvian children to be a public necessity and social interest. Under the Act, various public organizations and other bodies are to cooperate in implementing a Three-Year Plan to reduce the mortality rate to 15/1000. In addition, the Executive Power is to take steps to have various international and private organizations direct their resources to this end. The Executive Power is to formulate and execute the Three-Year Plan within 60 days.

This Resolution sets forth the Regulations on the organization and functions of the Peruvian National Maternal-Child Institute, created by Supreme Decree No. 022-87-SA. The following are among the functions of the Institute: 1) to propose a policy of maternal-perinatal care; 2) to encourage and realize basic, clinical, and operative research, developing technologies appropriate to the national maternal-perinatal health situation; 3) to disseminate to all levels scientific results in the maternal-perinatal area; 4) to coordinate and develop specialized training programs in maternal-perinatal health directed at health personnel and the community; 5) to contribute to the improvement and training of all personnel participating in activities aimed at gynecological, obstetrical, and perinatal care; 6) to intensify the training of specialists required for the care of women and childbirth; 7) to facilitate the decentralization of maternal-child care in order to achieve specialized care; 8) to propose rules and procedures for maternal-perinatal care; 9) to advise the High Directorate of the Ministry of Health with respect to maternal-child care; 10) to coordinate, support, and evaluate activities carried out by public and other institutions directed at maternal-perinatal health care; and 11) to increase and improve the quality of institutional care services for women of child-bearing age, pregnant women, child-birth, and the recently born, with the priority of developing care of greater sophistication. Further provisions of the Resolution set forth the organization, interinstitutional relations, and resources of the Institute, among other things.

This Venezuela Resolution requires the performance of a cytological study in all medical offices providing family planning, pre- and postnatal care, adult hygiene, treatment for sexually transmitted diseases, and gynecological services and, in general, all medical offices in the public sector that treat women between the ages of 25 and 64. It also requires all patients treated in these offices who for any reason have to be admitted for hospitalization to undergo a cytological exam. The purpose of these activities is the prevention of uterine cancer.

This Accord sets forth the Regulations of the Organic Functions of the Ministry of Social Welfare of Ecuador. The following are among the Departments of the Ministry: 1) on the advisory level, the National Council of Minors; 2) on the operative level, the National Directorate for the Protection of Minors, consisting of the Department for the Protection of Minors, the Department for the Rehabilitation of Minors, the Department of Integral Health for Minors, and the Legal-Social Department for the protection of Minors; and a National Directorate of Women, consisting of a Technical Department and a Department of Promotion and Development. The functions of the National Directorate of Women are as follows: 1) to promote the participation of women and women's organizations, encouraging their incorporation into the socioeconomic development of the country; 2) to encourage and orient on a national level the creation of women's groups; 3) to advise and coordinate in the state and private sector the execution of programs and projects designed to improve the condition of Ecuadoran women; 4) to direct and execute programs and projects for women; 5) to promote the strengthening of women's organizations striving to obtain self-management for women and raise their standards of living; 6) to give opinions on the approval of statutes of women's organizations; 7) to supervise the implementation of programs and projects undertaken by organizations that receive contributions from the Ministry; 8) to direct and supervise the organization of a register of information related to women's organizations; and 9) to promote the dissemination of information for the implementation of programs and projects of the Directorate relating to women's organizations.

RESUMO

This Decree requires all persons or organizations interested in carrying out activities with respect to the promotion of health or prevention of illness in persons aged 60 and older to obtain authorization from the Costa Rica Ministry of Health. Authorizations are valid for five years. General and particular rules for the functioning of activities are to be issued by the Department for the Elderly in coordination with the Accreditation Commission of Health Establishments. The Decree calls for the Department for the Elderly to make periodic inspections of institutions and requires the Department to approve any publicity on activities. Authorization can be withdrawn from persons and organizations that violate the provisions of this Decree or other health laws and regulations.

PIP: This document presents the text of health legislation approved in Mexico on December 23, 1986, setting forth ethical issues and professional responsibilities in the area of health research. Health research is conceptualized as activities that contribute to knowledge regarding biological and physiological processes in humans; knowledge of the links between the causes of disease, medical practice, and social structures; prevention and control of health problems; evaluation of the harmful effects of the environment on health; the study of techniques recommended or used for the delivery of health services; and the production of goods for the health sector. Title 1 of these regulations outlines responsibilities of the Secretariat of Health and calls for the establishment of an Inter-Institutional Commission on Health Research. Title II defines ethical aspects of research on human subjects, with separate provisions for research involving minors, incompetent persons, women of childbearing age, pregnant women, women during labor or childbirth, nursing mothers, embryos, stillborn fetuses, and cadavers. In general, research is permissible on human subjects only if it confers health benefits and carries minimal risks. Title III sets forth regulations on research on new prophylactic, diagnostic, therapeutic, and rehabilitative methods, while Title IV concerns the biosafety of research. Clinical research in the field of pharmacology must include 4 phases preceded by full preclinical studies. Finally, Title V of this legislation defines the duties of internal committees in health institutions.^ieng

This Decree integrates a number of basic health programmes into a single programme called the Programme of Primary Attention. Within the new programme there are three types of services: a) services of direct attention to persons, which include maternal-child care, and family planning services, among other things; b) activities of attention to the surrounding environment; and c) complementary support services, which include health education, among other things. The family planning services provided consist of the orientation of women of fertile age and distribution of family planning materials (medios) following instructions of other agencies. Within the Programme there are also Education and Nutrition Centres, which give attention to children and pregnant and lactating women in the form of food, health and nutrition education, and attention to their growth and development.

PIP: This document contains provisions of Haiti's 1987 Constitution relating to the family; the protection of children, aliens, and refugees; and individual rights. The age of majority in Haiti is 18, and political and civil rights are attained at age 21 regardless of sex or marital status. Haitians are equal before the law but native-born Haitians who have never renounced their nationality have special advantages. Human rights are guaranteed in conformity with the Universal Declaration of the Rights of Man. Every citizen has the right to decent housing, education, food, and social security. The state is obligated to provide citizens with appropriate means to protect, maintain, and restore their health. Primary schooling is compulsory and free. Aliens in Haiti enjoy the protection offered citizens, including a limited right to own real property. Political refugees have a right to asylum. The family is considered the foundation of society and enjoys state protection regardless of whether the family is constituted within the bonds of marriage. Legal protection is afforded mothers, children, and the aged. The Constitution also calls for creation of a Family Code to ensure protection and respect for the rights of the family.^ieng

PIP: This document summarizes provisions of Mexico's 1984 General Law on Health. The law sets forth the objectives of the right to health protection as well as the objectives of the National Health System. Basic health services are defined as: 1) health education and the promotion of sanitation; 2) prevention and control of priority communicable diseases, the most frequent noncommunicable diseases, and accidents; 3) medical care; 4) maternal and child care; 5) family planning; 6) mental health; 7) the prevention and control of oral diseases; 8) the availability of medicaments and other essential supplies; 9) promotion of improved nutrition; and 10) social welfare for at-risk groups. The provisions in chapter 5 prioritize and define maternal and child care and call for protection of minors, activities to support the family and contribute to maternal and child health, appropriate standards of school hygiene, and health services for schoolchildren. Chapter 6 prioritizes delivery of family planning (FP) services to minors and adolescents. This chapter penalizes anyone performing sexual sterilization against a patient's will or unduly influencing a person to undergo sterilization. FP services are to include: 1) sex education, 2) care and surveillance of FP acceptors, 3) advisory functions, 4) research activities, 5) logistical and storage services, and 6) data collection. Additional chapters discuss the objectives of health education and provide that tissues may be removed from pregnant women for therapeutic purposes if the recipient is in danger of death and the removal poses no risk to the woman or the conceptus.^ieng
