Resumen Antecedentes: existen pocos estudios referentes a las quejas presentadas acerca de los médicos, limitando la retroalimentación y la educación, aspectos que ayudan a mejorar los servicios de salud y la calidad de atención. Objetivo: caracterizar las quejas con respecto a los médicos y sus consecuencias en Antioquia (2008-2013). Métodos: estudio descriptivo transversal. Se revisó la totalidad de quejas presentadas ante el Tribunal de Ética Médica de Antioquia, 2008-2013, que contaran con pronunciamiento al segundo semestre de 2018. Se evaluaron las características del personal implicado, el evento que motivó la queja, las normas vulneradas y la sanción. Resultados: se encontraron 679 médicos implicados en 461 quejas, 43,4% médicos generales. El principal motivo para presentar queja fue la mala atención percibida por los pacientes (20,9 %), y la principal norma por la cual se abrieron procesos fue la Ley 23 Articulo15, que habla del consentimiento informado (17,3 %), siendo también la más sancionada (16,2 %). A la mayoría de involucrados (58,6 %) les archivaron los procesos por no encontrar fundamento en motivo de la queja; sin embargo, a 23 (3,4 %) les impartieron sanción, siendo grave con suspensión en ejercicio de la medicina en 60,8 %. Un 17,4 % de los casos tuvieron censura pública, 13 % amonestación privada y 8,7 % censura escrita privada o censura verbal pública. Conclusiones: la omisión o mal diligenciamiento del consentimiento informado constituye el principal motivo de sanción; sin embargo, el verdadero detonante que lleva a presentar una queja, es la percepción de una mala atención. La educación ética transversal al ejercicio profesional es fundamental en la reducción de demandas por mala praxis.


Abstract Background: there are few studies about the complaints presented against physicians, limiting feedback and education, aspects that tend to improve health services and quality of care. Objective: to characterize the complaints against physicians and their consequences. Antioquia. 2008-2013. Methods: cross-sectional descriptive study. All complaints filed with the Medical Ethics Court of Antioquia, 2008-2013, which had a ruling in the second half of 2018, were reviewed. Characteristics of the personnel involved, event that motivated the complaint, violated regulations and sanction were evaluated. Results: among 679 doctors involved, 461 complaints were found, 43.4% of them general practitioners. The main reason for filing a complaint was the poor care received by patients (20.9%), and the main rule by which processes were opened was Law 23 Article 15, which speaks about informed consent (17.3%); being also the most sanctioned (16.2%). Most of doctors involved (58.6%) had the processes archived because the court did not find a basis for the complaint; however, 23 (3.4%) were sanctioned, with suspension from the practice of medicine in 60.8%. Of the remaining, 17.4% had public censorship, 13% private reprimand and 8.7% private written censorship or public verbal censorship. Conclusions: the omission or poor completion of the informed consent constitutes the main reason for sanction; however, the real trigger that leads to filing a complaint is the perception of poor attention. Continuous ethical education in professional practice is fundamental in reducing lawsuits for malpractice.
