RESUMO

Pretende-se rediscutir neste artigo a questão da universalização da inimputabilidade penal do criminoso psicótico pretendida pelo artigo 26 do Código Penal Brasileiro e pela Psiquiatria Forense, à luz da experiência psicanalítica, em uma prisão em Minas Gerais. O caso do jovem universitário assassino J. C. ilustra a importância do método clínico psicanalítico no processo de responsabilização subjetiva do criminoso psicótico.

This paper intends to readdress the question of the universalization of the psychotic offender's criminal incapacity intended by article 26 of the Brazilian Penal Code and by Forensic Psychiatry, in light of the psychoanalytic experience, in a prison in Minas Gerais state. The case of the young murderer college student J.C. illustrates the importance of the psychoanalytic clinical method in the process of subjective accountability of the psychotic offender.

Cet article est destiné à rediscuter la question de l'universalisation de la non-imputabilité pénale du psychotique criminel présumée dans l'article 26 du Code pénal brésilien et par la psychiatrie légale, à la lumière de l'expérience psychanalytique, dans une prison de Minas Gerais. Le cas du jeune universitaire meurtrier J.C. illustre l'importance de la méthode clinique psychanalytique dans le processus de responsabilisation subjective du psychotique criminel.

En este artículo, se pretende rediscutir el tema de la universalización de la inimputabilidad penal del criminal psicótico, pretendida por el art. 26 del Código Penal Brasileño y por la Psiquiatría Forense, a la luz de la experiencia psicoanalítica, en una prisión en Minas Gerais. El caso de J.C., un joven universitario asesino, ilustra la importancia del método clínico psicoanalítico en el proceso de responsabilidad subjetiva del criminal psicótico.

Dieser Artikel erörtert anhand der psychoanalytischen Erfahrung das Problem der Universalisierung der Strafunmündigkeit des psychotischen Verbrechers, welche vom Artikel 26 des brasilianischen Strafgesetzbuches und der Forensischen Psychiatrie vorgeschrieben wird. Der Fall des jungen Studenten und Mörders J. C. veranschaulicht die Bedeutung der psychoanalytischen klinischen Methode im Prozess des subjektiven zur-Rechenschaft-ziehen des psychotischen Verbrechers.

RESUMO

Levando-se em consideração que é indubitável a relevância da tragédia à Psicanálise, o presente artigo visa revisitar a tragédia de Sófocles, Antígona, utilizada por Lacan como ponto de virada em seu estudo sobre a Ética, em O Seminário, livro 7, enfatizando a posição da heroína nesse entre--duas-leis, as leis da Pólis, que transgride em nome de leis não escritas, divinas, pelas quais, segundo ela, vale a pena morrer. Com breve incursão no que representam tais conceitos no mundo jurídico, visa-se demonstrar, que, em que pese a diferenciação simbólica entre leis humanas e leis divinas, a única lei que verdadeiramente se impõe ao sujeito humano é a lei do desejo, que comanda e pelo qual o sujeito deve se responsabilizar.(AU)

Once that is undoubtful the relevance of the tragedy to Psychoanalysis, this article aims to revisit Sophocles’tragedy Antigone, adopted by Lacan as the turning point in his study of ethics, emphasizing the heroine’s position in this ‘between the two laws’, the Polis’ laws, which she infringes in the name of the unwritten laws, divines in their origin, which, according to her, it was worth dying for. With a brief foray into those concepts in the legal world, we intend to demonstrate that, despite the symbolic differentiation between human and divine laws, the only Law that really imposes itself to the human subject is the Law of Desire, who commands and for which the subject must take responsibility.(AU)
