Containing health care spending growth will require changing the amount and form of new health care technology. But even if new technology lowers real resource costs by reducing the use of medical care (as through personalized medicine or by producing cost offsets), it might not lower the rate of growth of spending when patents are present: higher net value may translate into a higher price for patented products. To lower long-run spending growth, it may be necessary to change patent policy by reducing the term of patent life or linking spending growth targets to net benefits from patented products.

New diagnostic or therapeutic options (NDTOs) are remunerated separately in the German DRG system. The Institute for Remuneration in Hospitals decides which proposed NDTOs are accepted for separate remuneration for 1 year. With this acceptance, hospitals can enter negotiations with insurance companies for an individual price of the NDTO. Because there are no general recommendations for these negotiations, we present a scheme for how to calculate an NDTO, based on the example of the NDTO for transurethral resection of bladder tumors using photodynamic diagnostic with hexaminolevulinic acid.

According to German civil law the physician's services rendered to the patient must be in accordance with the medical state of art, which must regularly be adapted to successfully evaluated innovations. In the German statutory health insurance most of the services are financed under budgets. Budgets do not satisfactorily reflect the growing needs of an innovative medical system. Hence, the legislative organs have to take action in order to carry out a reform of the statutory health system that enables free enterprise, competition and the patient's free choice of services.

The statutory health insurance reform law of 1993 had a serious impact on the management of university hospitals. Firstly, the phase of strict budget caps, new in and out patient services could only be introduced when compensated with the elimination of other services. Most universities have mastered this challenge. In the second phase, an entirely new system of hospital fees will be introduced. This will lead to a high degree of uncertainty on the financial situation of the university hospitals. The new regulation on hospital fees only insufficiently takes into consideration tertiary care hospitals. A severe loss of income has to be reckoned with. The funding of current subsidies for medical research, training, construction projects and big-ticket equipment is threatened by the fiscal budget crisis due to the current recession and the heavy financial burdens of the German reunification. Therefore fundamental reforms with regard to the statutory form, the form of ownership, the responsibilities of the university hospital, the organization of management and decision processes, the public service law and investment financing are all unavoidable.

The German Health Care System is internationally recognized as having a high quality and efficiency for the total population. Rising costs of the Statutory Sickness Funds burden the employers and the employees in the same way. With the Health Structure Reform Act of January 1, 1993, federally induced systems for restructuring in part and for creating more competition are aimed to limit further growth rates of compulsory health insurance to a reasonable amount. The regulations with respect to electromedical devices and large, hightech systems are discussed in detail. But in the health care system technical progress also stimulates efficiency, initiates rationalisation, and contributes to a saving in costs.

The analysis emphasises the dependence of medical-technological progress on the zero fees for standard health services. Technologies with an additional or total self-payment are discriminated against by the patients and the physicians. Besides, a tendency to apply medical maximum standards was discerned. The enforcement of novel methods of diagnosis and therapy has been made substantially easier. In contrast, there are scarcely any incentives to introduce cost-saving technologies from the patient's point of view. The fixed budgets of the Health Structure Act will exercise greater pressure on introducing cost-cutting innovations.

The diffusion of technology in the US has taken place in an environment of both regulation and free enterprise. Each has been subject to manipulation by doctors and medical administrators that has fostered unprecedented ethical dilemmas and legal challenges. Understanding these developments and historical precedents may allow a more rational diffusion policy for medical technology in the future.

Advances in technology and medical knowledge, combined with economic pressures, have allowed patients formerly cared for in a hospital setting to have access to comparable services at home. These advances, however, are accompanied by new risks and liabilities for the health care provider.
